In 2009, Morgan and Morgan established the Business Trial Group with a simple, yet novel objective – provide clients with first-rate commercial litigation attorneys on a contingency basis.
By combining the resources of a preeminent trial law firm with the expertise of career business lawyers, we have built a reputation for getting results by aggressively fighting for our clients.
We have recovered tens of millions of dollars on behalf of our clients. Our attorneys have established a track record of success, and many have honed their craft at prominent national and international law firms. But what makes them different from other business litigators is that our attorneys are real trial lawyers, skilled at taking complex cases to jury trial and winning.
We take on complex cases and well-funded adversaries. Whether it comes to staffing, technical experts, or sophisticated document management systems, we give our clients an edge.
We practice business litigation solely on a contingency-fee basis, so our compensation is directly tied to our client’s success. Our clients pay no attorneys’ fees unless we prevail.
Earn Compensation for the Business Cases You Refer
The Business Trial Group provides our referral partners with a unique financial opportunity. Lawyers that refer business cases to us receive a share of the contingency fee. Whether your client does not want to pay hourly, a case is more expensive than anticipated, you do not handle commercial litigation or you do not handle trial work, referring your client to the Business Trial Group will generate revenue at no cost to your firm.
When you refer your business clients, we share our contingency-fee recovery with you. The fee you receive will be a percentage of any settlement or judgment from your client’s case. These referral fees are shared in strict accordance with each state’s Rules of Professional Conduct.
Type of Business Cases for Referral
The Business Trial Group has the expertise, experience and resources to handle a variety of business cases. Our attorneys are experienced with, and have successfully litigated, a wide range of commercial cases related to professional liability, contract disputes, intellectual property, real estate, construction, probate, securities and many other issues.
We do not, however, handle any hourly or defense litigation and we have no transactional practice. That means if you refer a client to us, the relationship will be limited to the case that you referred. We will honor and respect the relationship between you and your client.

- Benjamin Webster
Benjamin Webster is a trial lawyer and co-managing partner of the Morgan & Morgan Business Trial Group, and specializes in handling complex business litigation on a contingency fee basis. Over his career, he has seen many individuals and businesses with significant claims unable to obtain access to the civil justice system or properly pursue their claims due to the inability to pay the attorneys’ fees required by the traditional hourly fee model. At Morgan & Morgan, Mr. Webster provides representation to clients involved in business disputes on a contingency fee (success fee) model, which allows his clients to obtain the best and most efficient results possible, regardless of their financial position. Using the success fee model, he has recovered tens of millions of dollars for his clients through jury verdicts and settlements. In particular, Mr. Webster has first-chaired numerous trials and obtained a number of significant jury verdicts for his business clients.
